They are refusing payment, because I'm moving?

I am trying to get into a new apartment on 8/22/09. I was told that I need to start making arrangements to get my last broken lease paid off. I tried calling the old apts directly, but they said they no longer had anything to do with it. Then I contacted the collection agency that had it, Procollect Inc. She asked if I was moving and I made the mistake of saying yes. She started saying that I would have to pay the balance in full, she wouldn't accept payments. I said I could afford $100 per month, she said that since I was moving she could offer me a settlement of $754 to be paid in full. But then she wouldn't be able to send payment verification to my apartment.. so REALLY it wouldn't do me any good anyway?! What do I do?!


I am assuming you wouldnt need to sen the Payment verification letter to the apartment, you would just need to get the Paid in full letter directly from the company. take it yourself to the apartment. yea we all learn what not to say to collection agencies after the fact.

depending on your state check with your states website dept. of finance or who regulates the collection agencies. she maybe doing everything legal but doesnt hurt to double check. Here in WA, they allow a person to call and ask questions over the phone, very friendly.

Actually, they know that you *must* pay them so you can move and so you may have lost your bargaining power by revealing that, unfortunately.

But at any rate, you shouldn't pay a settlement offer without an agreement in writing anyway, even if you did have the money.

Interestingly enough, they are on Bud Hibb's list of bad (illegal acting) debt collectors, but the last report is dated Dec 2008.

Also, they have been sued for FDCPA violations 6 times, but the last time was in October of 2008! So it looks like they may be good now, but it is still best to get any agreements in writing first, otherwise you have no legal leg to stand on if they should decide to sell it to a Junk Debt Buyer sometime in the future...

But, they have 114 complaints on the BBB, 42 of them with the last 12 months.

I moved out of these apartments in June of 08.. they have always known how to get in touch with me so they aren't scared they'll never get it. They have sent me an offer before to take partial payments and it was actually last month. I wasn't planning on paying it by the 8/31/09 deadline so I tossed it. Can I still ask them about it you think?
