Collection Agency Validation Issues - Help!!

I recently received a letter from a collections agency for a medical bill from over a year ago. I was not aware of anything being owed, and as far as I was concerned, services were rendered at the time of the appointment.

I sent them a validation letter, requesting proof as found from sample letters here on this site.

They replied fast, telling me that they have now reported my account to the credit bureaus, and I can contact them to pay if I want to have it removed.

They also included an original invoice from the Debtor, showing that I owed the money, but they have not provided me with proof that I agreed to pay any fee to these people. How can they just send a bill a year later? I was told I would not owe anything, and now they are trying to collect on something. There is no contract between me and the debtor because I never signed anything.

Now that I am disputing it, they reported it to the bureaus. I am pissed. I sent them a second validation letter today explaining that the first attempt was not proper validation. I explained that they did not validate the debt, and did not provide the information I requested. I am awaiting a response.

What are my rights here? As far as the law says, the document they provided is proof enough. How do I fight this? I asked them within the 30 days to validate this, and never said I was disputing it, I just asked for validation, and now they are reporting it to the bureaus. What can I do?

PS - I am married to a law student who will be a lawyer in less than a year.

I called the Doctors office and was told they are no longer handling the bill. Also, when I went in for the service, I was told that what my insurance didnt't cover would be "written off". They did this with all of my other charges. Really feeling stuck here. This collection company has no proof I owe anything. They just sent me an old invoice. I also asked them to prove they had the authority to collect the debt, or prove they bought the debt, this was not provided. Is that really validation?

The CA does not have to prove to you they have the authority to collect the debt or prove they bought the debt. There is no law that requires this. You can ask them whether they bought it or where assigned the debt 3rd party. Heck, the doctors office could give you that answer.

Sound like you need to talk to the insurance company and get an EOB to prove what was paid.
