need help

i had a car in my grandmother's name and it got repossessed. after the bank sold the car, my grandmother owes over $1300. i don't have the money to pay the balance because the payment arrangement they are proposing is something i cannot afford. they want $200 a month. the thing is my grandmother is 85 years old and on an fixed income. right now my grandmother is going to get a cash advance off her discover card to pay if off to keep them from harassing her. i told her that they probably would not sue her because they could not collect because she is on a fixed income and they could not garnish her income. what advice can anyone give me.


I have to say that they will not care about a fixed income or not, they will sue just to get the judgement set in stone and then collect anyway they can. Whether it be even after your grandmother passes if she is 85, they would put a lein on the estate.

This people will sue to get their intrest satisfied, have no doubt, they are ruthless when it comes to collecting debt.

If they don't sue, you will be lucky. How are they harrassing, if it is by phone can you change the phone number? This will probably be the only way to stop the calls.

Let your grandmother know that there is no debtors prison, at her age I would not do the cash advance, they are a lot more pushy if you miss the payment.

I think what she meant by fixed income is SSI, which can NOT be touched by filing suit....if this is her fixed income, then she doesn't have that to worry about. I am not sure about pensions, so hopefully someone else can shed light on that one. If she owns her home they might be able to put a lien on it..depends on her state laws, some states do not allow for the home you live in to be touched..usually called homesteader laws and such.
