CA pulling report after SOL

Got a call from Portfolio Recovery about a 6 year old debt (I live in California 4 yr SOL) they said that they will pull my credit report every 9 months until I pay the debt.

If they are legally unable to collect how can they legally pull a copy of my report?

She said the pull would also effect my score. Could be considered a considered a collection action?

i am sending out the Validation Letter tomorrow.

Get that validation letter out ASAP! Portfolio is a bunch of animals. Very hard to deal with.

They need to prove that you really owe this debt. If it's out of SOL then they should not be collecting on it. That's not to say they won't try. And many many people fall for the tricks. That's how they stay in business.

I would also send a cease and desist from them calling you at home or work, and written correspondence only. I'd even put a paragraph in there about not authorizing them to pull a hard inquiry on your credit report. That sounds funny to me...It should be just a peek at your report that doesn't affect your score. You didn't apply for credit with them.

Keep a close eye on your credit reports. Hopefully you belong to a monitoring service.

Oh yes CB, it is certainly a threat, why else would a company need to pull your CR that often? That is certainly a FCRA violation. CA is a two party recording state requiring the consent of all parties involved in the conversation. However you may use a recording device that emits an audible beep or state at the beginning of the call this call is being recorded, if you continue this call you are giving your consent for this recording (or something to that effect) If they contact you any further after you send the cease comm. letter then you can sue them for 1k per call.
