Getting The Run Around

I recently was served with a summons to go to court due to a debt I owe. I thought that I had already established payment arrangements with the CA since they cashed 2 of my checks. I was wondering what I should do Should I respond to summons I contacted their atty letting him know about the checks he asked me send copies and i faxed them now he wants me to contact CA so I called them today and they said the will call me back I'm thinking of filing a complaint on them regarding abuse of process they filed court papers on 12/13 and my check was cashed on 12/10 I'm confused I live in CA Please help

The attorney filed the papers after he got the case. It could have been weeks before the actual filing when he received your case. Attorneys move at a snails pace as a rule. The CA had no business cashing those checks it they no longer were in possession of the case. I would definately file a complaint against the CA. Do not ignore the summons. You must show up in court or you will lose by default. Bring your checks as proof that the amount you owe should be reduced.
