Have you signed any written agreement where you have promised to return the car at a certain location? If yes, then they can sue you. I think its best to return the car to the agreed location. This way, the car rental company can get their car back and will not sue you.

yes the thing is, in the contract, it says that I can pay to have it recovered and the owner is acting like this doesnt exist. he says if it were in the "allowed states" then it would apply. yet he wants the contract to apply in other ways where he can charge me. I want to pay to have him retrieve it. I dont want to b/c colorado has massive avalanche warnings right now and its insane there.
