CA and Credit your credit report

Are Collection agencies allowed to obtain a full copy of your credit report to try and use against you in court?


I received a disclosure statement from the plaintiff today. (Disclosure is initiated voluntarily and then manditory to opposing party) It is the disclosure of information (everything) that is planned to be used at trial to present or defend it's case. It is something my county court rules allow for before trial. Going over one of the supplied disclosure exibits is Exibit E, a TransUnion Consumer Credit Report. Thier copy of my TU Credit report is not a true copy of my TU credit report. It has alot of old information in there that is not on the recent copy I obtained. It also has another new different account number for the account that they are collecting for. The copy of the CR is altered but I don't want to have to bring that up in court because I don't think that a whole bunch of false information reported in this credit history is relevant to the case! What can I do about this? Can I ask to have non relevant information in the exibit thrown out?

You definitely want to bring in your current (hopefully you had it sent to you and not printed out from the computer) CR and challenge the Authenticity of their document. If it is printed out from the computer the doc can be alter to someone's advantage.

This might be a crucial part of their proof of the debt, get it tossed and their case gets weaker.

I printed mine from the computer. Thier copy was requested and issued to the subscriber on the same day. Do CA print thier copies from the computer as well? It sure looks like it and strangely, the've only displayed the negitive information, none of the good standing stuff. Also added negitive information only displayed on Equifax report. Could I request that the CR information (especially the irrelivant information) not be included as evidence since there are ongoing disputes with all three of the Credit Bureaus? I don't think I want to have to disprove authenticity by having to provide plaintiff with authentic data of the actual account.

This is exactly the CR entry that plaintiff says "includes information on the account" and plaintiff plans to use this prove the debt belongs to me. #1. There isn't an account number that relates to the account number for which they are trying to collect #2. There isn't any information here that relates any amount owed on the account. #3. All it basicly reveals is some dates that they are trying to use to confirm the debt is owed by me. Could I have this whole credit report thrown out because it contains to evidentry value?
