I have been served with a lawsuit from Michael J. Scott. I requested debt validation from Michael J Scott and Capital One prior to the filing of the lawsuit but never received anything from MJS and only received a form letter from Capital One saying they were referring my request to the appropriate department. I am prepared to answer the complaint but need to know if I include copies of the letters I was sent from MJS and Capital One as well as my request for validation and the certified mail receipts?


Sure you can include them but it is somewhat pointless. Cap One still owns the debt and can and will validate during the discovery phase. Are you disputing the debt?? Or just validating for the sake of validation.

Your original validation request is probably the reason the lawsuit was filed.
