Since Amex is the original creditor, they do not have to cease contacting you by phone, unless you live in one of the few states that grants those rights to you in regards to the original creditor. I live in California, and California law does apply to the OC. However, the fdcpa does not apply to OCs.
If you live in California, then you can send a cease and desist
If you live in California, then you can send a cease and desist letter to the original creditor. I did it with a few of mine that were more annoying than most, and the only one who still persisted in contacting me was Advanta. Since that was a business credit card, they said that the consumer credit laws didn't apply to them.
I'm not sure what exact law it is, but basically I think you have the same protections that the fdcpa gives, except that California law applies it to original creditors also.
