question about old debt
Date: Sat, 01/05/2008 - 22:49
Hi. I live in IL. I have about $6500 in credit card, medical bills, and phone bill debt. I have received collection letters about 4 years ago, and then me and my wife, we moved and I have never received a letter or a phone call after that. Also, apperantly i am being sued by one credit card company. I know there were summons served but they went to the address that I lived in 6 years ago, so I never responded to them. I wanted to find out what will happen next since I didn't respond to the summons. Also, most of my debt will fall off my credit report later this year and next year. My other question is, will my wife be affected by this in any way? I don't have any banking accounts but she does. will they be able to get into her stuff? Also, we are trying to open a business under her name and I want to make sure my old mistakes will not afftect her in any way. Please help... thanks to all of you..
You should check to see if they got a default judgement against
You should check to see if they got a default judgement against you, likely that they did. You can use the fact that you never got served properly against it, but you might want to get a lawyer to help you on that. The judgement will make that particular debt stay on your credit. I would DV it as well, force them to prove this debt is yours. As for your wife, I am not sure how that would work..is your state a community property state? Someone will be along that knows more about this then I. :)
