I have one account (Sears) that went to LVNV about a year ago. I was in a Debt Settlement pgm at the time and didn't really know what I was doing then, so no DV was sent out. I received a dunning letter from Leading Edge in Nov 2008, followed by one in Dec 08 from Resurgent on this account.

I hadn't heard anything else on it, but for the last month or so I've been getting calls from Resurgent from different numbers, every 3-4 days or so. They never leave a message, but when looking up the phone numbers, others have posted they are Resurgent.

Anyway, I'm wondering if anyone has ever had a collection that was with Resurgent move to another CA. Or once with Resurgent they always stay with them? I know Resurgent is part of LVNV so maybe that is all they will use on me now. I'm hoping for another CA to give it a try so I can DV them.

LVNV owns the account. They like to play the legal shell game of sending it to various subsidiaries or contractors, only to pull it back when you demand validation or otherwise stand up to them. Then they (LVNV) send it to the next shell company, and the process starts all over again. Send both Resurgent and LVNV a DV letter, CMRRR. First thing Monday morning, if not today. If you only DV Resurgent, chances are it'll get pulled and sent to another shell co. Then you have to start all over.

In your DV, one thing you want to ask for is proof of who actually owns the account in question. It's likely that LVNV bought the account outright from Sears. When I was dealing with Resurgent on behalf of my wife, Resurgent kept trying to make out like Citi still owned the account. I had to social-engineer the LVNV connection out of them.
