Riddle & Associates trying to collect on a 9 year old debt!
Date: Mon, 06/22/2009 - 07:20
Hey everyone,
I read some posts regarding this CA but was hoping someone can give me help specific for my situation.
At age 18 in 2000 (9 years ago) I had a Bally's membership. I went maybe twice, never went back, and have been contacted by letter by Asset Acceptance Corporation starting in 2007. I ignored the letters because this was a very old debt.
On Saturday I received a phone call from Riddle and Associates asking me what I plan on doing about this debt. I told them to send me something in writing and we will take it from there.
The statute of limitations for written contracts in Florida is 5 years so how can they try to collect on this debt now? Can I be sued and if so do I have to hire a lawyer? I mean this is ridiculous...any help you can give would be appreciated.

Just because SOL has expired does not render an unpaid debt uncollectible. They cannot sue you and since this is past SOL and federal reporting period, send them a full cease comm. When they sell it off to another JDB, rinse and repeat.
