I have a new sticky situation. My parents received a call from Riexinger & Associates, LLC and he gave me the number to get in contact with them. I have a feeling it is about my Citicard account but I am very scared, are they going to sue me? Anytime I have tried talking to debt collectors they have pressured me and made me cry I was so humiliated. What should I do? I am scared :( Thanks guys and take care!

Riexinger & Associates, LLC is a GA based Collection Agency. Did you find their name in your credit report?
As per the FDCPA, the CA need to send you a dunning letter in order to start the process of debt collection. However, you may send them a debt validation letter by certified mail and get the debt validated first. Until they validate your debt, they cannot take any legal action against you.

It is impossible to tell if they will sue you or not, but if you don't communicate with them they will be *more* likely to sue..

There seem to be hardly any complaints about them so you should be alright. Just remember: document everything!

Call them and verify your mailing address so they can send you the dunning letter. Try to work out a payment arrangement or a settlement.

Hi guys thanks for your thoughts I appreciate it. I sent them an email to contact only me and my number but I have heard/read off and on whether or not they are a real law firm or just a collections agency. I am nervous, should I give them my address so they can mail me a letter before I start dealing with them? Thanks again!

This situation has gotten worse ugh! So I emailed the company (or law firm) and they called this morning around 9ish. I was in class but I just got home and saw I had two missed calls from them and four text messages. When I opened the text message it had their phone number and made me redial back to them, so I ended up calling them, ugh. Is that illegal? How can they do something like that? Now I can't even check my text message box with a fear I will end up calling them accidentally.

These idiots called me looking for someone who had my phone number over four years ago. I filed a complaint against them with the State Bar of Georgia, which is pending. They obviously are too cheap to do their homework, in my opinion. Here is my letter to the Georgia State Bar:

Re: Complaint against Riexinger & Assoc.
Gentlemen:
At 6:11 p.m. yesterday evening I received a collection call from an attorney licensed in your state. The call was actually directed for a Mr. David Lopez, who had my phone number years ago. I have had my phone number, through Verizon, for almost four years now. Anyway, the caller identified herself as "Rachael" and left me a message to return her call, which I did this morning.
When I called the law firm this morning, I was transferred to Rachael. She said she would remove my number from their calling list. When I asked where she got the list from, she became rude. At that point, I asked her why I shouldn’t file a complaint against her law firm, she replied "You do whatever you want to do."
I thought lawyers were held to a higher standard than this. If a lawyer from Georgia wants to harass us sun-loving hillbillies down here in Florida, shouldn’t they at least spend the extra dime to get an updated calling list? One must wonder if every peanut picking pettifogger in the great state of Georgia has nothing better to do these days.
If I need to do anything further to prosecute these horrible misdeeds, please contact the undersigned.

John Polivick
(not David Lopez
