Repo/Collection Question
Date: Wed, 07/20/2011 - 22:13
I went through a rough time back in 2004. I had a car loan that I could not pay on. The car was repo'd in 2005. I am now being sued by Midland credit for the balance. What is the SOL on this? Does the SOL start at the time payments were not being made and loan in default or from the time the repo occurred? I live in Colorado. Thanks in advance for any help

In the documents they forwarded there is a notice of right to cure dated 10/4/04. So It would have been prior to that. Then on the statement of Repo it says deliquent date as 2/1/05 and repod 8/22/05
Do I just go to the pretrial and state that it is beyond the SOL
Do I just go to the pretrial and state that it is beyond the SOL or what is the best way to proceed? Would it be in my best interest to get an attorney or is it not necessary
