This is the same guy as ASG, and if he wishes to have his Internet Provider notified of his "annoying" internet behavior, at a privately funded site, I will post the recent law for him: "Annoying someone via the Internet is now a federal crime.

It's no joke. Last Thursday, President Bush signed into law a prohibition on posting annoying Web messages or sending annoying e-mail messages without disclosing your true identity.

In other words, it's OK to flame someone on a mailing list or in a blog as long as you do it under your real name. Thank Congress for small favors, I guess.

This ridiculous prohibition, which would likely imperil much of Usenet, is buried in the so-called Violence Against Women and Department of Justice Reauthorization Act. Criminal penalties include stiff fines and two years in prison.

"The use of the word 'annoy' is particularly problematic," says Marv Johnson, legislative counsel for the American Civil Liberties Union. "What's annoying to one person may not be annoying to someone else."

It's illegal to annoy
A new federal law states that when you annoy someone on the Internet, you must disclose your identity. Here's the relevant language.

"Whoever...utilizes any device or software that can be used to originate telecommunications or other types of communications that are transmitted, in whole or in part, by the Internet... without disclosing his identity and with intent to annoy, abuse, threaten, or harass any person...who receives the communications...shall be fined under title 18 or imprisoned not more than two years, or both."
Buried deep in the new law is Sec. 113, an innocuously titled bit called "Preventing Cyberstalking." It rewrites existing telephone harassment law to prohibit anyone from using the Internet "without disclosing his identity and with intent to annoy."

To grease the rails for this idea, Sen. Arlen Specter, a Pennsylvania Republican, and the section's other sponsors slipped it into an unrelated, must-pass bill to fund the Department of Justice. The plan: to make it politically infeasible for politicians to oppose the measure.

The tactic worked. The bill cleared the House of Representatives by voice vote, and the Senate unanimously approved it Dec. 16.

There's an interesting side note. An earlier version that the House approved in September had radically different wording. It was reasonable by comparison, and criminalized only using an "interactive computer service" to cause someone "substantial emotional harm."

That kind of prohibition might make sense. But why should merely annoying someone be illegal?

There are perfectly legitimate reasons to set up a Web site or write something incendiary without telling everyone exactly who you are."

The internet laws have been in effect for quite a while.I even have a pdf brochure from the Fbi's website detailing all the crimes that are committed along with the charging statutes. :D As a matter of fact I used that particular file to squash a collector who broke the Spam act and the financial info provisions. I directed the member of who to notify and gave them a copy of the file by email. That particular debt was written off by the original creditor once they were aware of what happened. It was a good day for the advocates! :D

Gotta love the spammers! NOT! I saw the news reports, showing the spammer being arrested. As far as the reasoning behind the new law, I understand it. Women being stalked (anyone, male or female for that matter) on the internet. And less than a year ago I saw a Dateline piece where bullying has hit the internet. It had 2 families of teens who committed suicide because not only were they being bullied at school, but the ignorant bullies took the action to blogs, Harrassing, putting embarassing comments about the person, and even making threats against the victim. Very sad that it caused suicides. The ignorant ba$tards deserved to be charged with some type of crime involuntary manslaughter, something. So in that sense I am glad to see that there is a law out there. But, how can you really know if a person is giving their true identity?

So, if the website owner allows people to say things about other people who do not come to the website, who is breaking the law?

I know of a forum that was established to discuss another forum and it's members. They often criticize people they and make fun of them.

hmmm..."hobos"?

Last I knew, the definition of a hobo was someone with no fixed address....I'd be willing to bet 100% of us have homes. And let's not get into the whole issue of what kind of homes, shall we? That's already been done by another guest, long ago, who shall remain nameless...and he was proven wrong in heartbeat when he accused us all of living in rented 1-bedroom apartments...or something to that effect.

Grump Person said,

"Bunch of losers you truly are. Get a live hobos and pay your bills and stop whining. All you people do is nothing but complain about how you don't want to be harrassed but you don't pay your bills. TOTAL LOSERS!!"

FYI to you, Grump.....

Just because people come here to discuss their bills and how they are going to pay, or not pay them, does not classify them as losers, or hobos. Debt can happen to anyone, at anytime, unexpectedly.

It only takes a second to do something that you will regret for the rest of your life. Drive down the wrong road at the wrong time...... accident? Could wipe out your savings, humm...pay your bill on time and donk't complain? Everyones life can change today, next week or not at all.

There is not one soul on this site that has asked for help that does not want to pay there bills. They are here in order to do just that.

So, your comments really mean nothing to me but just another soul to pray for.

All the Best,
James
