i have old sandpointcapital loan that i thought was paid off. Its been almost a year ago. Its been sent to collections but i havent gotten nothing in 6 months. I live in kentucky internet paydayloans are illegal. They have threaten me with a summons.. Can they send me a summons. I had someone get in my bank account illegaly last year. The loans was for only 250. Can they take me to court for a ilegal paydayloan.

Under FDCPA Act, they can't harass you when collecting debt. If the payday loans are illegal in your state, then you are only liable to pay the principal amount. You don't have to pay the interest rates or any other fees. As they illegal, so I don't think they will file a lawsuit against you. They are most likely giving you false threats to make money out of you.
