I recently received judgement papers from a law firm/collection agency in new york representing sears. I live in florida and the account was also opened in florida. They are threating to garnish my wages. The credit card was opened in 2000 and the last payment made was july 2004. Should i respond to them or ignore them since the statue of limitations is expired on the debt?


I lived in New York in the early 90's, but that was years before I opened the account in Florida in 2000.

are you sure they were judgement papers? did they request for you to appear in court? if they had not alot of these savvy collectors have made thier collection letters so sneeky that they look like court documents. first of all i would find out if you are actually getting summoned or if they are just a collection letter, whatever is goin on without admitting any guilt.

If its just a collection letter i would forget it if the states sol is expired. keep in mind they cannot garnish you without a judgement from court.
