Back in October, 2009 I sent request for validation to a collector for Sprint. Explained that I didn't owe the amount because phone was lost, Sprint notified, etc. etc. I received the RR card, but never heard from them (Allied Interstate).

Now, I get a collection letter for the same account/same amount from a new collection agency (Progressive Mgmt. Systems).

Do I send them the same letter? Why is the account being sent to another collection agency?:evil:


First thing I would do is call progressive management and ask them if the account is marked as disputed.

Yes you send the same letter along with a copy of the letter you sent to Allied. Then talk to a consumer attorney about filing a lawsuit against Allied. If they didn't mark it as disputed and sold it then that is a 1. In order for PMS to collect on it, they would have to validate before collecting but if Allied didn't mark it as disputed they wouldn't know.

If it was marked disputed and PMS ignores it and continues collecting then they are liable. You could probably include both in the lawsuit and let each one prove thier case....Also check your credit reports.

Have you gone through your credit report? What is reported by the previous 2 collection agencies? Since you've not received any replies from the last 2 CAs, I'ld suggest you to meet your State Attorney General and file a case against them. You've the return receipts from Allied Interstate and PMS which will serve as a proof.

Moreover, if AI or PMS have not disputed the account in your report, then notify the credit bureaus about it and send them all the relevant documents as proof. The bureaus will ask the CAs to verify the account failing which the account will be removed from your report. Since you've suffered so long, just remember to sue these CAs.

I'm waiting for August 1st when I'm eligible for my yearly "free" credit report, and I will go through it line by line. It's annoying to have to keep responding to these CAs, but I guess I need "proof". Thanks for the suggestion. I will be contacting attorney for action against CollectCorp. and will include this also. Who knows, maybe I'll get lucky and be able to collect for their practices.......
