Notice of suit pending
Date: Sun, 12/09/2007 - 18:30
Yesterday I was served with a notice of suit for a debt orginating in 2000 (July 2000)with a write off date of 2001 (January 2001). From what I can find online the statute for limitations for Vermont is 6 years. How do I respond to the court and lawyer of the company with this information as it seems to me the statute has expired and a suit is not possible. Aso when does the clock start running on the statute when the last payment was made and the account comes 30 days due or when it is written off and sold to a collection agency?

Call the court clerks' office and ask them how to file an answer to the suit. But what ever you do Show up in court. If you hear anything from the attorney about the date being changed or postponed, verify it with the court, never trust their attorney. It is in their interest to get you to NOT show up (if you don't show they get a judgment in default, if you do show they have to actually earn their fees).
