Allied Interstate

Also got 2 collection/settlement letters from Allied Interstate.
For 2 different account they claim are mine. Have not yet sent anything out.
However, I seriously doubt that AI is gonna be able to do anything.
They failed to provide anything the last time I sent them validation request.
Plus, the accounts they allege are mine are well beyond SOL.
Thinking I need to send, CMRRR, a letter, stating accounts are beyond SOL, and that they too, are SOL-JWF. Or should I follow through with a validation request first, then tell them they are SOL-JWF??
As always, any help/information much appreciated.
Thanks.

Don't acknowledge the debts if they have crossed the SOL period in your state. No need to send them anything. If they call you, then tell them that debts have crossed the SOL period.

Actually, I would not recommend that you ignore this. I would also advise against notifying them about the SOL being expired at this time. Under almost any circumstance, I recommend sending a certified DV letter first. If you send a DV request, they cannot do anything until they validate. That is exactly what you want. If you go right for "the SOL is expired", then you are tipping your hand, so to speak, and at that point there is nothing to stop them from filing a 1099 and making you pay taxes on a debt that they did not even prove is legitimate. ALWAYS go to DV first--that way, they cannot legally do much of anything without validating. And while a DV letter does not all by itself make the 1099 illegal, imagine this--if you DV them, and they do not respond, but then they file a 1099, you can go to the IRS and show them that you requested proof in accordance with federal law, and they could not prove the debt is even yours. It gives you a case against a 1099 if they try to go that route. There have been cases where CA's have misused the 1099 to penalize people when they could not even validate the debt in the first place--at least this way, you have documented that you disputed the debt and they never proved it was even yours.
I'll work on DV letters as my LOA winds down. I recalling, but

I recalling, but can't remember, how long a 1099 can be filed.
I'm thinking that anything I had outstanding is beyond that point as well.
Can't say for absolute certain though. Yet.
But, if like at least once in the past, AI could not/did not validate.
Guess the last time I request validation from them, they failed to produce.
Apparently managed to get a judgement to boot. And I knew nothing of it, until
I called about something else.
Apparently they got it, failed to follow up on it, never attampted to renew, and it fell from record. This direct from police/court when I called to check on another apparent judgement I knew/know nothing about.
Oh well, that's a different story!
Anyway, greatly appreciate the info. Will work on DV in the next couple of days.
Thanks agai n.
