Dean McCoy is the representative who called me today for SGQ Processing. He threaten me today on my job by telling me that if I didn't pay 541.25 today I would be arrested on my job. He told me I could have it done with a credit card or I would have to surrender myself at a MoneyGram pay station. He told me that I was being charged with a felony of malicious intent to do something. Things went so fast today I can't remember the rest of that. I wanted to talk to SGQ myself and he told me I was talking with who I needed to talk to that they didn't want to talk to me. He said something about due process law and violating my rights. And a lawyer being appointed to me. I know that those wasn't my Miranda Warning be read to me but he was skipping around the exact wording. He made sure to tell me several times that I would be arrested if I didn't resolve this issue today. I only owe them $260. I do know for a fact that I gave them my next payday and they made the loan due back on the Friday before my payday. Who do I talk to about them?

Welcome! We are indeed glad you are here. First off, relax. Noone's going to come after you--this is a classic scare tactic.
What we need to know is: what state you are in? This way, we can check to see if this company is licensed in your state. And trust me, defaulting on a PDL is NOT a criminal offense, OK? And if they try and pull this again, tell them to come and get you! And watch how fast they hang up!!

I received a call from Chris Hamilton at Jackson, Phillips and ass. today who informed me I was going to be arrestted on my job if I did not come up with $805 today to pay a loan from 2005 which I thought was paid. he told me to contact him by 4:00 or it was going to be filed and I will be arrested at my job. I told him I would call him at 3:30 and for 30min the phone goes straight to voice mail and I cannot get thru. I guess I am realy stupid, but I don't know what to do or where to go!!

Janet,relax they are borderline criminals and no you won't be arrested.In fact if you give them your money it is highly unlikely your lender would see a dime! Look in my post above for the pub topic I posted.We have a reporter interested in them and he wants to hear from all of you. Also go to www.myfloridalegal.com and file a complaint with the Florida attorney general.he has an ongoing investigation looking into these guys.

I received a call today from a Chris hamilton with this firm. same conversation as I have been reading in the other posts. I actually was truly concerned because I have a wife and 4 kids to feed so I googled the agency and found your site. What is the story with this whole PDL and being able to arrest people??

Brian, the fact is simple--they cannot arrest you any more than I can.

You all have just experienced a scare tactic used by dishonest debt collectors. The goal is to make you think that the situation is so immediate that you have no time to research, or to check and see what rights you have. Let's start with a list of what they CANNOT DO TO YOU:

1--they CANNOT arrest you. Debt collection is considered a civil matter in such cases and not a criminal matter, so they cannot have you arrested on ANY criminal charges. Anyone who says they can is lying to you just to get money out of you.

2--they CANNOT collect on a debt unless they are licensed in your state to collect debts there. Check to see if they are by contacing your state offices such as 'secretary of state', or any consumer protection organizations--they can point you to the proper agency for your state.

3--They CANNOT threaten to take ANY action against you unless they are legally allowed to do it, and they also must be prepared to do it when they tell you they are going to. They cannot threaten to 'sue you tomorrow morning' for example, because the process of filing suit takes longer than one day.

Now, the single most important thing you need to know--it is called the Fair Debt Collection Practices Act. Do a search on the internet for that act, and read the whole thing. Then read it again. Learn those rights, know them well, because those collectors are breaking about a half dozen of those rights, and you can actually sue them for damages when they do! You can use the law to identify violations that these collectors use on you--then you can record the events and contact a lawyer of your own.

Of course, you can also get them at their own game a little bit too....the next time one of them calls, right at the beginning, when the person identifies themself and why they are calling, say this:

"Ah, yes, hang on a moment, let me turn this tape recorder on here....so I can document your illegal threats that violate the fdcpa and sue you and your company...."

If you do this, please let us know their response.

If you need more help, feel free to ask--anyone here will be more than happy to answer any questions. By all means, DO NOT SEND THESE PEOPLE THE AMOUNTS THEY ARE DEMANDING, because the only reason why they need to create so much urgency is because the amount is more than they should be getting. And this tactic they use--by the time you find out they overcharged you it is too late.

Welcome!! First off, let me say to all guests here, that noone is stupid for having got into the PDL mess and that is one phrase that we will never use here, because most of us (including myself) were in that trap at one time and are getting out. So no, you aren't stupid--but are very smart for wanting to deal with this.
Second, YOU CAN NOT BE ARRESTED for defaulting on a PDL. This collection company, which is made up of excons, thieves and liars, is LYING to you!!
The important thing is to determine whether your PDL's are storefront or internet-based. If they are internet-based, chances are they are not licensed to do business in your state, but double check this using the google function here. If they are storefront, the opposite is probably true--that they would be licensed, but again, double check this.
If they are licensed, your chances of going to civil (not criminal) court are greater, so these PDL's must be dealt with first.
Obviously you owe your principal (what your borrowed) at a legal interest rate. If you have rolled these PDL's over numerous times, you have probably overpaid the loan, so you should total this up.
If you have, demand that your accounts be marked PIF (Paid in Full) or file claims with your state's Attorney General.
Finally, go to Cajun's thread in the Pub marked "Important Annoucement for Victims of Bass and Associates". Bass is a DBA of Jackson Phillips, so please read the thread, which has information on how to email a reporter at the Jacksonville, Fla newspaper who is doing a story on Bass. Good luck!

What is up with PDL, SGQ, and everything else. I'm curious to know this now. I took out a loan with SGQ, but what I took out was $150 and I have been getting the same calls that you guys are getting. Is all this fake and have I been sucked into a scam to mess up my banking account?

So what's the deal with this PDL, SGQ, and everything else. Is this comapany a fraud or something because I took out a loan with SGQ for $150 and they have taken over $200 from my account and now turned it over to a collection agency because they said that I haven't paid anything towards this loan. I read what some of you were saying and I am going down this road now. Can anyone tell me what type of company SGQ really is. I live in WI and have had the same thing done to me. They called me at work and threaten to have me arrested. They said that I had committed a very serious crime. They wouldn't let talk kept telling me that they would do the talking and I was to listen. I have idea of how to get in touch with them to even pay the money back. Can you tell me about the company and the collection agency. Thank you Randy

There are numerous threads about this company and their various DBA's on the forums and you can see how scummy they really are. First off, they are in clear violation of the fdcpa by falsely threatening arrest, so relax on that score. You do not have to put up with their harassment by phone, period.

Today I received a letter from Accounts receivable technologies. This is a collection agency for SGQ Processing. It states that I owe them $672.00. The whole thing is I never took out a loan from this company, I tried and was declined. What do I do from here? I have never received anything prior to this letter, no phone calls, no emails or snail mail. Has anyone ever heard of this collection agency?

The burden of proof is on the company to show that you really owe this debt. Write them back and ask for what's called a debt validation letter, where they have to show you that this is indeed your debt. If they can't, then demand that this file be closed. And do this within 30 days of the date of the letter.

I got a call today stating I had defaulted against a loan. They said they will be prosecuting & contacting my job unless I make a payment today & fax an apology & payment agreement today.
She says she's from National Payday representing a company.
Won't say which company. Assuming SGQ.
What do I do? I live in Oregon.

I did take out a pdl with them. I had to close my checking account due to it being hacked. I called to let them know and find out an alternate way to make my payment. I was informed I would have to wait until my payment was declined and to call back on Tuesday. I have since left 4 messages and sent and email and nobody will respond to me. I am positive I will start receiving the threatening phone calls any day now. I want to pay what I owe - no more.
