Being hassled by shady credit card company

I won't lie. I'm deep in debt, and it's my fault I got there. I got a bit behind with one card, and I can understand them calling ME to discuss the matter. But, now they're just flat out crossing the line. They have called my employer and they have called relatives of mine and discussed the debt in detail with THEM! This is an outrage! Why would they do something like this? I thought I had read that this was in violation of the privacy act. Is there anything I can do?

Welcome to the Forum. Find out as much information as you can about them. Send them a DV letter to make sure everything is valid and if you know that they have been calling family and discussing it with others they are breaking law. They are not allowed to disclose any information with them. You have come to the right place. More people on here will have more knowledge then myself. But don't let them push you around. Don't avoid them and see if you can work something out. If you avoid them and try to sue you and you don't show up they will pass judgement against you and you will have to pay regardless.

I am no expert but it sounds to me like it is a violation of the Gramm-Leach Billey Act. Specifically, Subchapter I, Sec. 6801-6809 - Disclosure of Nonpublic Personal Information. I work for a Financial Institution and it is a big deal. We are required to be retrained on it yearly. It is my understanding that ALL Financial Institutions are required by law to abide by this and it is enforced by the FTC. See link to this law below:

I am not a lawyer, but I know that collection agencies cannot call relatives or employers; but I think CC companies can legally call you and your relatives at home and at work to try and track you down. If you are not paying, you are in breach of contract and they are trying to protect their interests.

You can send them a cease and desist letter, certified mail, return receipt requested, and see if that stops the calls. It can't hurt. If you are still paying your minimums, you should not be being harrassed.
