I have been repaying a personal loan to a former friend, but unfortunately I have fallen behind and cannot keep up with the payments of nearly $700/month. Without going into a lot of details, I know this person intends to sue me in small claims court. I am in Texas.

Has anyone been sued in small claims and can you tell me exactly what the process is and what happens?

Do they send someone out to serve you, or do they just mail it?
Do they notify your spouse?
Will the judge let you work out payments?
What happens if they get a judgment?

Thanks!

You will be served a summons by a third party.
They dont notify your spouse, but you should.
The judge might let you work out payments, but it wont necessarily prevent the judgment.
If they get a judgment, they will be able to levy your bank account and lein any property with your name attached. Since you are in texas, you cannot be garnished.
