I thought the sol for illinois was 7 years is that true?

how long is the statue of repose? ...does illinois have one and can you explain it a bit?

Does it go in effect directly after the sol is up?


SOL in IL is 5 years for open accounts and 10 for written. IL does not have a Statute of Repose. Only MS (3years) and WI (6 years) have the SOR. The SOR would extinguish the debt on expiration of SOL making it uncollectilble. As if it never existed. The reason I brought it up in your other post was since you were a resident of MS, if the 3 year SOL had expired while you were still a resident of MS, then the underlying debt would be subject to the SOR.

The SOL on my charge off is definitely over then.

..... Would I still have to pay it via a Collection Agency, since it is charged off?

..... Are credit cards always consider Opened accounts?

..... And if this went to court could I bring the SOL to the judge for a ruling in my favor?

Do you know where I can find legal description for the IL SOL?
