Date: Sat, 09/27/2008 - 12:21
I called and they told me it was from 2001 and they did have an old phone number I used... so maybe I do, maybe I do not, but thing if Im really upset they reported it, instead of sending me a bill !
.
SOL has gone by even if I did owe it, what do I send them to make them stop reporting on the sol issue?. Then the other issue I dont think I actually do, if I do, why didnt they tell me?
They have totally wrecked my credit report for years now it looks like. What do I do? What letter do I send? Thanks.
If it was from 2001 the reporting period may have already expire
If it was from 2001 the reporting period may have already expired or be close to expiring. Call the reporting CRA's and ask for the Date of First Default as reported by the data furnisher.
still confused.
They told me june of 2001. The SOL in my state is past.
and I never recall nt paying my att bill.
-should I send them a verify letter?
-is there another thing I can do?
Send them a DV letter CMRRR. Track it online and when they show
Send them a DV letter CMRRR. Track it online and when they show that they have received it, dispute the tradeline with all 3 CRA's as obsolete. If they verify the TL before validating the debt, then they have violated the fdcpa.
this is way over my head, I will try to read more about this. th

Estimated date that this item will be removed: 03/2011
in plain english please, tell me what to send and how to word it? A link would be alright.

the truth about this account, even if you legitimately owe it, is that they are breaking the law based no what you have said so far. Federal law allows that a debt can be reported on your credit report for a maximum of 7.5 years from "date of initial delinquency". This is important--it is NOT the date that the account was sent to collections, but the date the account first became past due. So, that June 2001 date when it was first sent to collections is, for reporting purposes, irrelevant anyways. The date that really matters is when the account first became delinquent. And if it was first sent to collections in June 2001, then your chances are quite good that the original creditor had held onto that debt for somewhere around 3-6 months as a past-due debt before they sent it off to collections.....maybe longer, maybe not, but AT&T doesnt ususally hurry accounts off to outside collections like that.
Also, something else is wierd with this--AT&T and Southwestern Bell are two different companies--and you said that they indicated to you that this was an AT&T/SWB account? SWB is a bell subsudiary, not an AT&T subsidiary....sounds fishy to me. AT&T was broken up in 1983 and since that time has no longer been allowed to use Bell as the name of any of their companies as far as I recall.
Somethign else you have them on is that they are falsely reporting that date on your credit reports. That is an FCRA violation and if they report it that way on all three reports, then it is three separate violations. Each one is worth up to $1000 in your pocket in a lawsuit. It it will help you, you can list some more of the details on exactly what they reported, they might have made other violations as well. Thats the good thing about FCRA violations--you can sue for each individual violation.....with the fdcpa law, all violations together will get you a maximum of $1000 plus any actual damages. But they are re-aging the debt right there, purely illegal to do that.
OK,
