Hello. I had a capital one credit card that had been charged off on my credit report. I then received letters from northland asking for a settlement in 2011. I am currently in the process of filing bankruptcy and I have not been contacted by capital one or northland for about a year for collection. Do you know how I can still claim this on my bankruptcy? Im not sure who holds the collection and this morning I checked my report and northland last looked at my report last month. But as I said before I have not had any contact with northland or capital one so I am not sure how to file it for my bankruptcy. Please help I am very stuck on what to do I want to make sure the acct. from capital one is added to my bankruptcy.


When we did our BK in the past for Medical reasons, I was told to include everyone that I owed to, if you know that it was with capital one and then sold to collection - include them both to be safe. I was also told that if you missed someone off the original list, like it was then sold to someone else without your knowledge. As long as the original debt was incurred prior to the filing date it still is included.

hope this helps some, your lawyer or if you were like us the person that prepared your paperwork for you to file should have a drafted letter you can keep to send out to any one that comes out of the wood work after the fact.
