How do i stop the harassing phone calls

Hi,
I'm not the one that owes First National Collection Bureau money but yet for the past 2 years they have been calling my house asking for a man by the name of Patrick. And for 2 years i have told them many many times that there is no person by that name that lives in my house nor do i know anyone with the name patrick and i being really nice about too. But they must not believe me because they call my house 10 times in a day and i will pick up the phone and tell them sorry you have the wrong number then they tell me to stop lying and need to put this man on the phone other wise i will get in trouble for helping him hide from his debt. I have asked till i was blue in the face to have my number taken off there call list and they tell me it takes 72 hours to be taken off there list...But they never take my number of any list because i get phone calls that start a 6am and they do not stop calling till 12:01am.. Can anyone please help me to stop the harassment!!! I need any help any one has to give. thank you jayjendrew


What state do you live in? In most states it is legal to record phone calls without even telling the other party that youre doing it. If you are in a one-party state I would definitely do this:

1--get a microcassette recorder that hooks to your phone line.

2--record the calls, including the date and time. There is a law that says they cannot call you before 8 am or after 9 pm unless you give them specific permission to do so. So, the next time they call you late at night, I would make it a point to say on the recording "It is ____, why are you calling so late?" Either way, get some recordings where you are telling them again and again that they have the wrong number. Let them keep telling you that you need to stop lying. Even better if they disclose that they are calling in an attempt to collect a debt--third party disclosure is a big no-no.

3--when you have some recorded calls, get back to me. Depending on what you have them saying on tape, and what time those calls were received, your next step would be to contact an attorney and file suit against them IMMEDIATELY for all the harassment they have put you through.

Calls to third parties (i.e., to parties other than the consumer alleged to owe the debt) are regulated by FDCPA 804.

1. They can only ask if you have location information for the party.
2. They cannot disclose to the third party that the consumer is alleged to owe any debt.
3. The cannot communicate with a third party more than once unless the debt collector reasonably believes that your earlier response was erroneous or incomplete, and that they have reason to believe that you now have complete or correct information.

Tell them that they have no basis for holding your prior statements to be erroneous, and thus their continued calls are a clear violation of FDCPA 804(3).
