Today I was served with a summons where I am being sued by Capital One and the kicker is the statue of limitations is up in 5 mths, its nearly been 6 years. I called and agreed to a payment arrangement, so not to have to go to court. Will this reflect on my credit report and what if I make a few payments and quit, or what if I make no payments. The main thing is I want it to fall off my credit report like it should next year, what should I do here. Will the judgement show up on my credit report even though we settled out.


If you go to a court and a judgement is granted it will stay on your credit report for upto ten years. If you make a payment plan before you go to court and they withdraw the complaint you will restart your SoL with the repayment plan so starting to pay then stopping isn't going to be a good option for you.

Hi Crystal,

I think you'll feel a lot better knowing that you are paying on this debt with the arrangement you've made with the company. Please don't stop paying...not only because it'll start the sol again...but because you'll take care of a debt you know is yours. Keep in contact with them and it'll all work out :)
