I live in Ohio and received papers from the County Clerk of courts saying I was filed against by this company and Larry Roach represents them. It is my debt. It is within the SOL for Ohio-6 years.
1. How do I file a motion for dismissal and what happens if they file a garnishment? I understand they will file a garnishment if I don't respond.I am just back to work after being part of the millions unemployed across the USA.

You cannot request a dismissal. File an intent to defend (commonly known as an "Answer") and show up in court. During the time between now and your hearing date, try and work out a payment plan with the CA. If you cannot work out an arrangement with the CA before your hearing date, try and work out an arrangement with Plaintiff's attorney the day of your hearing. I am quite sure that all the CA wants is for you to voluntarily pay the debt. Just make sure that what you offer is the same or more than what they would get on a wage garnishment.
