Citibank is sueing

:?: OK.....I just recieved a summons from a lawfirm representing citibank who says I owe them 5500.00. I only had one citi card in my life when I was 18 and it had a 500 limit. I transferred that dabt to my GM card and it says on my credit report it(citi) was closed by consumer. Which is fine. I have never recieved any collection calls...letters...or anything. Now they are trying to sue me....I don't understand it. For their exibit A on the summons it just has my name account number (which doesn't match the one on my report) and % interest and chrage-off balance and charge off date of Aug of "01" then in the next page it says chrage off date of 5-17-04....what the hell??? I am so upset....I don't know what to do....I have NO knowledge of this debt what so ever. Any advice???~~~Tom


I just realized it's not citibank that is sueing. It's A&A North American Financial who admitted they BOUGHT the supposed debt from Citi when it was charged off in "01". It was 2195.00 then. Now it's supposedly 5556.00. WOW! These people are NUTZ! SO it jumps over 100%!!!! I live in Michigan....IF this debt was mine wouldn't the statue of limitations be up on it if it were bought by someone else in 01???

Breach of Contract: 6 years, (MCL 600.5807( 8 ).

Breach of Contract for Sale of goods under the UCC: 4 years: including deficiency actions following repossession and sale of goods subject to a security interest, (MCL 440.2725(1).

Not sure which applies but either way it looks like the SOL is up.

SOL runs from the date of last payment so if it was charged off in 2001 and no further payments have been made on this account then it is indeed a time barred debt.
