I have seen posts here that state that Suttell and Associates are not licensed in the State of Washington. If they are a law firm based out of Washington state how is it that they are not licensed in this state for collections. Doesn't make sense to me. I do know that they trump up interest charges. I had a capital one account that they have had since 2008 per credit report and just got notice from them for full payment of 3200 a full 1200 more than my credit limit was. Need some advice on this.

Thanks

Washington laws require a collection agency to be licensed in the state. If they are not licensed, they are not authorized to collect the debt. There are existing discussions in this forum about Suttell and Associates. To check them out, you may visit the following links.

Thanks for the information but it did not answer my question. I went to dept of licensing for Washington State and did not find them to be listed for being licensed in this state for collections. Unless I am looking in the wrong place how can they get away with this?

Because enough people pay them without checking. Let's say they have 100 Washington collections averaging $1000.00. If they collect 5, they have collected $5,000. More then likely you will just tell them they aren't licensed and can't collect. The odds are at best maybe one person will sue them for collection activities while not licensed. So they have gained $4,000.00 without a license. It's profitable. That's why. There is no agency who has the manpower to monitor the collection agencies. In this case, as it is state law, that would fall to your state to monitor it. You can contact your attorney general and they may be able to do something about it.

The moderator is wrong about WA law. For accurate information cotact an attorney. An atioeny has an exemption from licensing as a collection agency per RCW 19.16.

However, Suttell is a "debt collector" as defined by the FDCPA, 15 USC 1692a(6). The National association of consumer advocates is a group of attoneys that take your kind of case. They have a referral list. Our firm has pending lawsuits against Suttell in Easten District SWashington Federal Court. i would be intereested in more information from you. we a re also invesitigating claims against Capitol One especially those collected by Suttell.
