This company has just contacted me on an alleged debt that dates back to 2005. They have given personal financial information to my husband. The state I live in is not a community state. Even though I have proof that I do not owe the debt, they refuse to review the information. They keep threatening me with damage to my credit rating if I do not send them a check. Isn't this extortion?? What can I do?

Hi!
Welcome to the Forums!

You should send a debt validation letter to the collection agency. If you don't owe the debt, then I don't think they will be able to validate the debt. Send a Cease and Desist letter if you don't receive the validation letter. Another thing, check the Sol period in your state. If the Sol period on the debt has expired, then they can't sue you.

Only in MA does the debtor have to give permission to disclose to the spouse so probably nothing illegal there.

Did you sent in a written dispute with your proof that you do not owe the debt? If they are regular reporters to the CA, and you have not paid the debt or sent in a dispute, it would not be extortion...it would be normal business practices. You cannot dispute verbally.
