I am hoping that someone will reply soon to this post and give me some advice, but I have another question. I am going to send in a $50 payment regardless of what the agency is telling me. There is a payment stub at the bottom of a letter that they sent to me. I figured I would include that with each payment, so it would get applied to the account correctly.
I noticed on the bottom of the stub it says the following:
Quote:
"We reserve the right to process checks electronically by transmitting the routing, account, and check number to the bank. By submitting a check, you authorize us to initiate an electronic debit from your account. A returned check mya be collected electronically if it is returned for insufficent funds." |
Does this mean that they have to right to deposit the check or does it mean that they have the right to electronically deduct other amounts from my bank account?
ridiculous payment amount
The problem is that your account is seriously delinquent. Paying 50.00 per month on a current account won't even cover the monthly interest, you might as well take your 50.00 and give it to an attorney. Your best bet is to settle and put this whole thing behind you. Regarding a citibank with ARS, call and offer 50% in 4 payments. Get it done and move on, otherwise you'll be paying alot more in the future, when you end up in front of a judge, trying to explain why you didn't hold up your end of the contract that was originally signed.
