I just received a summond from Mark Walsh, legal recovery attorneys today. They represent for Capital one bank, who charged off my debt one year ago, sued me for my credit card amount that I owed Capital one bank. I am a poor student, live in CA, and I was not able to make payments for Capital one bank cards when they increased my APR to 29%. They did charge off my debt one year ago.
Question:
1. Mark Walsh sued me is illegal since the debt was charged off one year ago? Do they have the right to collect my debt which is charged off one year ago?
2. I don't have money to pay for attorneys, so I will do-it-myself and I need to answer the summonds asap. I did not see the answer form which should come with the summonds? Would you please help me by showing me or guide me how to get all the forms?
3. Do you have a guideline or any books (I am going to buy the books and learn) to show me how can I deal with a debt buyers lawsuits.
I am truly appreciated your help. Please help me because I am so confused how I can deal with this debt buyer lawsuit from Mark Walsh, legal recovery firms.

Charge off is just for book-keeping, has no bearing on the debt
Charge off is just for book-keeping, has no bearing on the debt itself and is still collectible.
