sued after debt repayment plan agreement

I have an ongoing repayment plan with a creditor (open book account). Payments are up to date and I have a written agreement for the repayment plan. After 5 months of making payments, i got sued by them. What can I do? Is the repayment plan a contract? I can't afford a lump sum payment of the debt. Can I make the repayment plan prevail in court? Does any body know of jurisprudence in a similar matter? Any help is appreciated.


If you were making the payments as per the payment plan, then why did they sue you? If you have the repayment plan in writing with you, then you can show it in the court and take steps so that it prevails and the court dismisses the case against you. You can contact an attorney and he will better guide you in this matter.
