My question involves judgment recovery in the State of Georgia. What are my options for a judgment against me regarding an old credit card debt (five to seven years ago). I recently became unemployed and I am on unemployment. A lawyer has receive judgment against me by a judge ruling. Can I fight this judgment? Can they take my unemployment money out of my checking account. Is there anything I can do about this?:


In the state of georgia that can't take my unemployment? I don't own my car or home - I own on them. This lawyer sent me a letter and has given me 14 days to respond with my checking account and my home and car. How do you file a vacant of judgment and do you have to have a good excuse? This credit was way out of the SOL. Thanks

You cant vacate a judgement because of a good excuse. You must respond to the attorney with all the info they are requested or they could get you on contempt. They cant garnish your unemployment but they will be able to put a lien on your home.

If you didnt answer the summons or fight it in court, you are out of luck. That was your opportunity to dispute it.

A lien on my house...what if I can't pay it anyway because of losing my job. I am trying to work with a credit counselor about my house. What does a lien mean? I am sending the attorney a response to his questions and I am asking him for a feasible agreement or terms. I can only offer him maybe $10 a month. Do you think that will surifice.

When a lein is placed, the house cannot be sold without the lein being satisfied.

No...they are not going to stop a judgment for $10/month.

I hope you are not wasting a lot of cash working with a credit counselor on your home. Have you applied for a modification on your home directly with your lender?

I meant do you think they will accept $10/month until I get a job and can pay more. I mailed them back a letter asking for their terms. Can they take my vehicle (paid for) if I tell them that is all I can pay - it really is. My lender basically said they couldn't help me, that i don't qualify for any of their plans. I have contacted the Home Safe Georgia - however they say that could take up to 12 weeks - it has been two.
