My mom has been diagnosed with dementia and it is progressing. She does not live with me and hasn't for over 2 years now. I am now receiving phone calls and letters from Attorneys, Henrique & Hunt looking for my mom.
Someone came to our door approx 2 weeks ago wanting to serve papers and again I told him that she does not live here. Just today I received another letter from their office.
As of yet, none of us kids are her 'power of attorney' or executor for her financial obligations. I'm thinking that perhaps she should file BK.
My question to you is, she only gets her social security every month and can they garnish her check from social security?

Send the attornies office a WRITTEN cease and desist letter. Te
Send the attornies office a WRITTEN cease and desist letter. Tell them she has not lived with you for 2 years. Tell them her only income is Social Security which they cannot garnish and that she has progressive demetia. (If she is living in a care facility, tell them, but do not give her location) Tell them you are not POA and even if you were, there are no funds. Demand that they never contact you by any method ever again. Send it certified mail, return receipt requested.
