Long story short 12 years ago I had a credit card go into collections and was sold to a collection agency who then sold it to Midland Credit. Midland put 15 different listings on my credit report for the same account, but changed the dates and account number for each listing. I fought it with the reporting agency(s) and won. They removed all accounts since it was over the 7 year limit. For the past 2 years I have been getting daily recorded messages from Midland. Midland sold the same account to 4 different collection agencies that call me daily. The one I had yesterday was a new collection agency that claims my last payment to this card was in 2001 and that they would sue if I didn't pay them over $4,000 or make payment arrangements. Well, I know that it is uncollectable, not on my credit report, and no way in heck am I going to agree to make payments not to mention the original amount of the credit card was $422. I asked for their company name and address so I could mail them and she started yelling at me about how I AM going to pay this bill and that they HAVE WAITED SINCE 2001 to get their money. I said not to contact me again unless they are willing to give me the name of their company and address. This all stems from Midland. How can I get them to stop? About two months ago I started a log of each computerized and live call I get from these agencies and it amounts to 4 on Sundays and 12 on Monday-Saturday each day. This is getting ridiculous.


I am pretty sure they keep selling it. Just got off the phone with a new one called Portfolio Recovery. They wanted my SS# which I refused to give but said I owed them for the same account Midland keeps trying to collect on. They said they bought the account last week but can't give details on the account. So, now that makes about 6 collection agencies collecting on the same old debt. How can this keep getting sold and still be collected by all of them?

Just in the span of 3 hours I got phone calls from Midland itself, Bennett Law Firm, and Portfolio Recovery all for the same CC account from over 10 years ago.

You need to send each of these agencies a C&D letter. Make sure you send it via certified mail with a return receipt requested.

If Midland actually owns it at this point, any collection efforts (by them directly or if they sell off or assign the account to someone else) after they receive the C&D would be FDCPA violations and you can sue THEM.
