HELP! I'm being sued
Date: Thu, 10/06/2011 - 12:55
I'm hoping someone can guide me as I've never been sued before so this is all so new to me.
I just received papers the other day for a lawsuit on a credit card that I had completely forgotten I had. It's been since '07 and although I probably paid about 3 months on the credit card can't remember really it's been so long, I do know that I owe on it since it's come to light.
My question is this, what do I do now that I have these papers in hand? I just started a new job and can't take the time off to go to court. However, I don't want the courts to come to my house and start taking property.
I'm willing to work out a payment plan but I'm not really sure how to do it.
The total of the lawsuit is like $2,500 but, that's for a ton of late fees. The credit card initially had a credit limit of $1,500.
Could someone please help me?
Thank you

Unless you want a default judgment, you have to appear in court.
Unless you want a default judgment, you have to appear in court. And they will not come to your house and take stuff. However with a default judgment they can garnish your wages and levy your bank account.
My suggestion if you can is to call the attorney and settle this asap before going to court.
Now, as you have already received the summons, you will have to
Now, as you have already received the summons, you will have to answer to that so that the creditor is not able to win a default judgment against you. After answering to the summons, you can talk to the attorney and reach an out of court settlement to avoid the judgment.
