I was served this morning with papers from Capitol One. Is there any way to tell when the last payment was made by looking at my credit report? My credit report shows the following: Sep 2011: $1,972 / October 1, 2007 / no data / no data Would this mean that Oct 1, 2007 is the date of last payment? If so then I believe the SOL is expired. I am in Arizona and the SOL was 3 years until April of 2011. Since my debt expired in Oct of 2010 would I be grandfathered in? I called the AZ AG and they said they don't interpret law. Does anyone else know? Should I get a lawyer or try to fight this myself? If I do get a lawyer and win based on SOL would they have to pay my lawyer? Thank you for the help. I am very stressed.

Are you sure that the SOL period in Arizona is 3 years? I have read somewhere that the SOL period on the credit card debts have been extended to 6 years. Please check it once. The last payment seems to have been made on September 2007.

If the SOL period has expired, then you can inform the judge about it. This will help you win the case. It will be better to fight the case with a lawyer.
