Capital Management Sevices collecting on behalf of Resurgent Capital
Date: Tue, 02/28/2012 - 13:28
I recently received a collection letter from Capital Management services about a credit card debt that they are collecting for Resurgent Capital Services.
I have already been through all the debt validation with Resurgent, LVNV and a few of their sister companies. My credit report is showing LVNV and I have disputed this in the past with them and with the credit reporting agency. I received a verified from the credit reporting agency, either experian or Equifax but it is showing as disputed by consumer.
I have not heard anything in about 2 years since I sent a C&D letter to LVNV.
My question is, if the debt is listed as disputed by consumer on my credit report under LVNV, can one of their other companies now try to collect when this debt is disputed?
Also, on the letter I received from Capital Management Services, it is stating that it is for a debt for LVNV for ABC credit card but the creditor listed on the debt payment from Capital Management is for a DEF credit card.
I am going to send a DV letter but wondered if I should mention that it appears to be a bogus debt. The SOL is up in 8/12 as I am in Calif.
Any insight would be appreciated.
Thanks,
Mr. Cali
How is the debt bogus? Was this your debt? Just because the SO
How is the debt bogus? Was this your debt? Just because the SOL has run out, the debt doesnt go away...you still owe and they have the right to attempt to collect. They just cannot pursue you thru the courts.

The reason I said it was bogus is that Capital Management Services said they are collecting for LVNV Funding for Capital One credit card but the debt that LVNV Funding supposedly bought was from HSBC credit card company and they never validated it. Even going through all the other companies that they farm out to. I send validation (cmrrr) and never hear from them again.
I don't mind paying someone for the debt even though it is almost at 4 years but I want to make sure that they are authorized to collect. As they stated this was for a Capital One and not HSBC, it makes me wonder.
I forgot to mention that I do not owe Capital one anything other than my current credit card with them.
Thanks,
Mr. Cali
HSBC is now owned by Cap One
Just an fyi - know its months after your post but earlier this year, Cap One acquired HSBC's credit card division. I have cards with both and it was maybe late spring, mid-year when my HSBC notices started showing Cap One's name.
