Debt Recovery Solutions -- Fraudulent Letters
Date: Mon, 01/25/2010 - 21:19
About a week ago, I sent a PFD letter to Debt Recovery Solutions regarding a T-Mobile Account. I was offering a payment of 25% of the amount.
I received a letter a few days ago from Debt Recovery Solutions (DRS) stating:
"Pursuant to your conversation with this office, this letter will confirm that you have agreed to repay the above noted sum under the following terms:
$400 to be received by this office on or before 02/10/10
$300 to received by this office on or before 03/10/10"
I never made such an offer and I had only contactd them once by letter. I had offered to pay around $260 to DRS...that's it.
So, I contactd Debt Recovery Solutions, and disputed the repayment agreement. I asked that the representative refer to my one and only prior communication with DRS. She transferred me to another person who I presume was a manager.
Well, what an angry...umm (choosing my words carefully)...person she was. She claimed that they couldn't contact me by phone, and that was why they sent me the letter. Huh? According to her logic, they can't reach me by phone, so they assume that's tacit agreement to repayment terms?!?! She also claimed that she sent me the letter, though the name on the bottom of the letter did not match the name she gave me.
I informed her that I had not received any form of debt validation from the company. She said that she would send it to me. End of conversation.
I was ready to begin negotiations...figure on some mutually agreeable terms. No dice. And, after such rudeness, I do want to deal with DRS...whether to pay in full or for a lesser amount. I'm still a human being on the other side of the line. Dealing with DRS for the first time left an awful taste in my mouth.
Just venting....

If you search the collector in the site you can learn what others have said about them. If they have continued the collection activities prior to replying to your validation latter, they have clearly violated the FDCPA and you then certainly have a case against them.
