I was wondering what generally happens when the debt collector attorney dismisses without prejudice prior to trial and returns the file to the original creditor.

We recently appeared at trial against Hanna and won (they had no evidence or witnesses). They refused to dismiss with prejudice (never hurts to ask). It was an alleged credit card debt with Capital One.

What is the likelihood Capital One will try and send the file to another firm? Is Hanna gone for good since they dismissed their action?


They only have 2 chances to sue, the first time is usually without prejudice, the second time is an automatic with prejudice if the case is dismissed. Keep proof of the prior filing in case it is heard again. It doesn't matter who comes after you either, If Fred Hanna tries to sue again Capital One, Bugs Bunny,,,,,,either way if you get a dismissal it will be with prejudice.
