threats from collection agency

has anyone ever had any dealings with CHECK AND CREDIT SERVICES LLC? they have an account from 2007 where i had a payday loan and are just now calling and making threats of fraud, a visit from the county sherriff, internet fraud and so on. Investigator Rose called and left a message stating that she was filing papers in my county and gave a "case number" to go with it. At first I was scared and was just before paying it and then I spoke with an attorney and was advised of my rights. I am now in the process of filing bankruptcy and when I told them JOHN CLARK advised me that this debt was not dischargeable in banruptcybecause it was a loan against future earnings. Well according to my attorney it is and it has been filed. My attorney has 40 years experience and has filed numerous defaulted payday loans with the bankruptcy court. please people let me know if you have had any dealings with this company. I am also filing a complaint with the FTC, NC attorney general and the FDCA. Dont let these scoundrals intimidate you. Use the power that you have to call their bluff. And the best piece of advice i can give you DO NOT EVER APPLY FOR A PAYDAY LOAN!!!!!!!!!


Investigator Rose is probably some bogus character created by an illegal payday lender, I wouldn't worry about their threats. You really should file complaints against this company though with the FTC, your AG and the BBB. Just out of curiousity, what was the name of the payday lender, and was it an Internet loan?

yes it was an internet loan and i cant remember the name of the company and they wont give any info. on the name of the company. now i just learned that they called my mom and gave out information that was false and also what it was concerning and if they didnt hear from mr by 3 they were filing papers in my county. cant wait to see how they react this week when they get my letter.

great advice unclewulf! im so going to use that one. hope these scoundrals go away. so far today the phone has been quiet. im sure they are harassing someone telling them im going to put this in the good pile if you agree to pay or the processing pile if you are no going to cooperate. then we will file in your county..blah blah blah. my problem was not paying back what i borrowed but they have added a ton of intrest and are not being nice. i hope they are reading this!!!

I get calls from them too. Everyday sometimes 2 and 3 times leaving threats of being served in the county that I live as well. I had agreed to pay them until I mentioned it to a co-worker and she informed me that most of these so called companies were scams that purchased these debts and were trying to collect on them and make commisssion off of the intrest. So I quit taking the calls last week and they are still calling leaving messages as to why I am avoiding them and they were supposedly filing papers on Friday of last week. Not sure if they will or not hopefully not. It is usually a different person each time they call. I mailed them a C&D letter, we will see if they respond to that. Why are these guys allowed to do these things?
