I posted a while back that one of my pdl's was sent to a collection agency LRA. I told them that I would need the debt validated, also faxed and mailed them the letter requesting this. I have not heard anything from since then. What I'm wondering is what happens now? Don't they have something like 30 days to respond to me? If they haven't gotten back to me within this time frame do you think this means they couldn't validate the debt? and if that's the case does that mean that I don't owe anything? Thank you for your help.


There isn't anything in the laws that gives a collection agency any time frame to validate a debt, so, basically, if they never validate the debt, they can't sue you nor can they attempt to collect the debt, they can't report it to any of the CRA's during the validation period either. If they do any of the above during the validation period without first validating the debt then they are in violation of the FDCPA and can be fined by the FDCPA (if you report them) and can be sued by you for up to $1000.00 for attempting to collect or $1000.00 per violation for reporting it to CRA's.
