Suing CA's

I was curious about something and wondered if anyone could shed light on this. Now Texas has some nifty laws that allows people to sue CA's for breaking Texas codes. What I was wondering if while you are suing for the Texas laws broke can you also sue for the federal laws broke in the same suit?

I just would be tickled pink if you could sue for Texas statute damages along with FDCPA and FCRA damages as well. :twisted:


I think you can, from what I have seen in Massachusetts, when a lawsuit is filed against a debt collector it is for FDCPAct violations along with 209 CMR 18.00 and CH 93A.

The FDCPAct and 209 CMR 18.00 mirror each other almost exactly with one exception, an attorney collecting on behalf of a client is not a debt collector under state law. Also MA law says a debt collector must be licensed.
