JDB and licensing?

I am preparing my answers/defenses to a summons and am also requesting production of documents. I don't guess I need to ask for verification of their licensing status do I? And I don't guess I need to point out that they don't have a license?

You are correct, Georgia has no license or bond requirements, unfortunately. Make sure to ask for everything to prove the debt such as contract and/or agreement, last statement that shows final balance owed and proof they are legally able to collect on it ( either a bill of sale or proof they are collecting on behalf of the owner)...you can even demand a chain of custody on who all has owned said debt...sometimes a judge will allow it, sometimes they will allow it to be objected:)
If they produce an affidavit, object to it as hearsay because how can ANY person who works for the CA have personal knowledge of the original debt? You have the right to question this person.

It is true that GA doesnt have a specific requirement for DEBT COLLECTORS to be licensed, but they DO have a specific requirement that ANY corporation wishing to conduct its business within GA must be licensed with the secretary of state. Wouldnt that still be a point to bring up--that the debt collector is attempting to act in violation of GA state statutes since they are not licensed to conduct any business within GA? That was my advice on this one...any thoughts?

Oooo I didn't see that...yeah you could bring that up! Would need to check with the secretary of state and if they don't, see if you can get a note on state letterhead saying so...explain what it is for, I am sure they will help and will likely send a strongly worded letter to them as well:)

I tried making calls yesterday and couldn't get anyone that seemed to understand. They kept wanting me to talk to the FDCPA people who didn't know anything either . . .
