When I asked my bank for the information regarding the Judgment they sent me a copy of the Judgment to levy my account at an address that I had live over three years ago.
Also This Debit is most definitely not mine.
I pulled a credit report and it was also on my report.
I sent a letter to the court that the Judgment was issue from and they were able to send me the forms to file a Motion to Vacate Default Judgment.
Now that I have the forms I found out that they sold the debt and now I got a notice from First National Collections Bureau for about 70% of the debt, Which is about $600. Again I have never done business with this creditor but this seem like it could be an uphill battle and even if i do get my motion to vacate its likely they will refile in court.
Here is my question:
If I settle this with the First National Collections Bureau will this allow to remove the current judgement?
Can they more then one agency attempt to collect if its settled?
I am currently not working and I feel that having this on my credit report will hinder my chances of finding a job.
Any suggestions?
Why would you pay anything if this debt is not yours??? Fill ou

Fill out the motion to vacate and get that sucker vacated.
Then IMMEDIATELY get a debt validation letter out to whoever is currently collecting upon it. Also check the info on your report, more then likely they are reporting wrongly. Fight this, if it is not your debt then you have rights!

Can anyone please explain what a debt validation letter is, as i am new to this forum?
Also where do I get this from? The collection place?

Ok, debt validation is a letter you write and send basically demanding to see proof of said debt such as a signed contract and/or agreement, a final statement that shows final balance, proof they own the debt or proof they are authorized to collect upon it. You want to see documentation that proves this is your debt...if it isn't yours, well...they will have a hard time coming up with this stuff.
You can find examples all over this site, but make sure you rewrite the letter to suit your specific needs because many CAs see a 'form' letter and don't take it seriously.

I was just getting ready to send out my Motion to Vacate and now today I got a letter from the court to appear on Monday (three states away) stating that I need to prove my Objection to Levy.
I sent both the court and Goldman & Warshaw to stop the
Levy due to the fact I and not working and my partner has been helping me with my bills.
I am guessing that with the short notice they are expecting me not to show…. They would be wrong. I will have to pick up with stage two when I get done with this.
I am bring all my bank statements for the past year but what else do you think I should bring to support my case?
Take your motion as they filed in the wrong place.
