When speaking of statue of limitations, it varies from state to state. My question is what state should you refer to? The state you lived in when debt was occured, the state you lived in when last payment was made, your legal state of residence, or the state you currently live in? The reason I'm asking is I applied for a credit card and recieved CC while living in Virginia, made my last payment while living in Nevada(balance still owed), defaulted while living in NV, joined Army and now live in Kentucky, but my legal residence is still NV. So, the account was open while living in VA, but went to collections while living in NV....anybody have any information?

Jurisdiction is based on where you currently live (domicile), where your legal residence is, or where you consent to go into court. If you pay your state taxes to NV, have a NV driver's license, are registered to vote in NV, then you are still a citizen of NV and should be brought into court there, regardless of where you are stationed.

Quite awhile back...1-2 years ago, I posted about a judge that went by the credit cards agreement that stated the laws of Virginia would be used. The credit card company lost that suit because they didn't abide by the Virginia SOL.

Sorry, but I can't remember what credit card it was.
