i have have been called at my workplace from a collection agency this was due to a broken lease and month free rent I received I have been making payment each month of $100 on this and they still want to take me to court. I have a judgement on me for a divorcee degree for paying half of mortage and car payments other companies. i can't pay more I just not have the money. I make under 30,000 and was told by collection agenices they can get more and win. Does the judge usually stand with the creidtor? or do I have a chance to explain my financial situation. I have been paying them each month and seems not good enough. I have no savings and my creidt is so bad I can't even get a loan to pay this. i can't afford an attorney either. any attorneys out there? I need some legal advice


Ok so basically you broke lease and didn't pay for rent for 1 month? I am surprised the complex didn't initiate eviction proceedings against you. Ok so did you get this payment arrangement in writing and did you send the collector a debt validation (DV) letter when they initially contacted you?

Also are you getting your wages garnished on this other judgment?

Basically if you go to court you can take in documentation for your financial status and show proof of your $100 payments a month the judge will likely set your payments to be the same or perhaps even smaller. Plus the judge will not be very happy that the CA is being greedy when you are already making a substantial payment each month.

BUT you do have the right to make sure this collection agency is in fact the correct one with the account and that they are charging the correct amount. Also you should always get these arrangements in writing for your protection.

You should check your credit reports and see if this company is applying your payments to the account (if it is listed). I would bet my left arm they are not reporting the payments each month. You can use this because they are not accurately reporting! So check asap.
